Terms of Service

These Terms of Service govern your use of Deposiq, a service of Horecarte BV. By creating an account or using the Service, you agree to these terms.

Template to be reviewed by legal counsel before it is relied upon.

1. Definitions

“Deposiq”, “we”, “us” means Horecarte BV. “Merchant”, “you” means the business that opens an account. “Guest” means the merchant’s customer from whom a deposit is requested. “Deposit” means a security deposit managed through the Service.

2. The Service

Deposiq is software that lets a merchant request, record, track, evidence and resolve security deposits, whatever method the guest uses to leave them. The Service is provided to businesses only; you confirm you are acting in the course of a business and are authorised to bind it.

3. What Deposiq is not

Deposiq is not a bank, payment institution or escrow provider. We do not hold, receive or transfer the deposit money. Card deposits are processed on your own connected Stripe or Mollie account; cash, bank-transfer and terminal deposits are recorded by you. You remain solely responsible for taking, holding, capturing and returning each deposit, for any dispute with a guest, and for compliance with the rules of your payment provider and applicable law.

4. Accounts & security

You are responsible for the accuracy of your account details and for keeping your credentials secure. New accounts may require approval before activation. You must notify us promptly of any unauthorised use.

5. Fees & billing

  • The first 10 deposits each calendar month are free. Additional deposits are charged at a flat €1 each — we never take a percentage of a deposit, and never charge for returning one.
  • Optional subscription plans (e.g. Pro at €29/month) unlock additional features; Enterprise is priced on request.
  • Fees are exclusive of VAT where applicable. We may change pricing with reasonable prior notice; changes do not apply retroactively.

6. Acceptable use

You agree not to misuse the Service, including: using it unlawfully; requesting deposits you are not entitled to; uploading unlawful content; attempting to breach security; or reselling the Service without our agreement.

7. Your responsibilities toward guests

As between you and the guest, you are the controller of the guest’s personal data. You must have a lawful basis to collect it, provide your own terms and privacy information to the guest, and handle deposits fairly and transparently. Our processing of that data on your behalf is governed by the Data Processing Agreement.

8. Intellectual property

The Service, its software and brand are owned by Horecarte BV. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You keep ownership of your own content and data.

9. Availability

We work to keep the Service available and secure, but it is provided on an “as is” and “as available” basis, without warranties of uninterrupted or error-free operation. We may carry out maintenance and updates.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or loss of a deposit that we never held. Our total liability in any 12-month period is limited to the fees you paid us in that period. Nothing limits liability that cannot be limited by law.

11. Term & termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms, non-payment, or where required by law. On termination we handle your data as set out in the Privacy Policy and DPA.

12. Data protection

Our handling of personal data is described in the Privacy Policy and, for data we process on your behalf, the Data Processing Agreement, which forms part of these terms.

13. Changes to these terms

We may update these terms; material changes will be notified through the Service. Continued use after changes take effect constitutes acceptance.

14. Governing law

These terms are governed by the laws of the Netherlands. Disputes are subject to the competent court in [The Hague / Rotterdam], without prejudice to any mandatory consumer or statutory rights.
